Here’s the issue… Any web site that transfer’s patient identifiable information and financial information must conform to HIPAA, SOX, and PCI security compliance. Disclaimers by software idiots are not acceptable excuses to undo all of the legislation presently in place. I expect the government should uphold the very laws they passed or repeal them. Short of repealing them, disclaimers are BS and aren’t worth the electrons it took to put them on your computer screen.
Read the HIPAA, SOX and PCI laws. Disclaimers are useless. They do not supersede the law. I have some on-line research studies ongoing. Do you think that by posting “all personal information you provide, including patient identifiable information, will be made public” will excuse me from law? How long do you think it would be before the IRB’s shut me down and bring me up on charges?
