No. It doesn’t beg the issue. Rights exist regardless of utility. Some could, and rightly so, argue that Joe Biden is of no utility. What then becomes of Joe?
We have the freedom of speech, but, clearly some speech is of no utility. Do we take away that particular speech because it is of no utility?
As to assault weapons, they have a utility.
